Draft. TrueFortis is not yet open to the public. Before launch, these terms will name the company that provides TrueFortis, its company number and registered office.
1. About these terms
These terms apply when you or your firm use TrueFortis. In these terms, "we" and "us" means the provider of TrueFortis, and "you" means the firm or person using it. By using TrueFortis you agree to these terms.
2. Who can use TrueFortis
TrueFortis is for businesses. You must be using it in the course of your business, such as an accountancy, bookkeeping, payroll or tax practice, and not as a consumer. The person who opens the account must be authorised to agree to these terms for the firm.
3. What we provide
TrueFortis lets you ask a client to verify their identity. Each check includes a document check, a selfie match, address verification, screening against sanctions and politically exposed person lists, 12 months of ongoing screening and a report you can download. What each check includes is described on our website. Our verification provider, Didit, carries out the verification and screening.
No identity check can detect every forged document or every person who is trying to deceive you. Screening depends on the lists available at the time of the check. We do not promise that a check will find every risk.
4. Your responsibilities
- You remain responsible for your own compliance with the Money Laundering Regulations 2017, including your firm wide risk assessment, customer due diligence, enhanced due diligence, ongoing monitoring and record keeping.
- You decide whether to act for a client. A result from TrueFortis is information to help you decide.
- You only send checks to people you have a genuine reason to verify, such as a new or existing client or someone connected to them.
- You tell the people you check how their information will be used, for example by referring them to our privacy notice alongside your own.
- If a check shows a possible sanctions match, you follow your firm's procedures, which may include reporting to the Office of Financial Sanctions Implementation.
- You keep your sign in details secure and tell us straight away if you think someone else has used your account.
- You keep your own copy of any report you need for your records. Download reports you must retain before you close your account.
5. Price and payment
Each check costs £4.99 per person, excluding VAT where VAT applies. Adding a company client is free; you pay for each director or beneficial owner you check. Your free sends are used first. A send is used when we send the link, whether or not the client completes the check, and sending a new link after one expires uses another.
After that, checks are paid from a prepaid balance. You top up your balance by card through our payment provider, Stripe, with a minimum top up of £20. The price of each check is taken from your balance when you send it, and given back if the check can't be started. There is no subscription and no setup fee. We will give you at least 30 days' notice by email before we change the price.
6. How we handle your clients' information
For the information of the people you check, you are the controller and we are your processor. When we process that information for you, we will:
- process it only on your documented instructions, which are these terms and your use of TrueFortis;
- make sure our staff and suppliers who handle it are bound by confidentiality;
- keep it secure using appropriate technical and organisational measures;
- only use the suppliers listed in our privacy notice, give you notice before adding a new one, and hold each one to data protection terms that protect the information to the same standard;
- help you respond to requests from people exercising their data protection rights;
- tell you without undue delay if we become aware of a personal data breach affecting your clients;
- help you with data protection impact assessments and consultations with the Information Commissioner's Office where needed;
- delete or return the information when you close your account, unless the law requires us to keep it; and
- give you the information you reasonably need to show that we meet these commitments.
7. Acceptable use
You must not use TrueFortis to:
- check someone without a lawful reason;
- vet employees, tenants or members of the public for purposes unrelated to your professional services;
- break the law, or help anyone else break it; or
- try to access information that belongs to another user, or interfere with how TrueFortis works.
8. Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Otherwise, we are not liable for loss of profit, loss of business, or any indirect or consequential loss. We are not liable for any fine, penalty or sanction imposed on you by your supervisor or any authority, or for your decision to act or not to act for a client. Our total liability to you in any 12 month period is limited to the amount you paid us for checks in that period.
9. Guides and information on this website
Our guides and other information on this website are general information only. They are not legal or compliance advice. They summarise official sources that can change, and we link to those sources so you can check them. You should not rely on them instead of the legislation, your supervisor's guidance or professional advice. To the extent the law allows, we are not liable for any loss arising from reliance on them.
10. Availability
We try to keep TrueFortis available at all times, but we can't promise it will never be interrupted. We may need to carry out maintenance, and our suppliers may have outages.
11. Suspending or closing an account
You can close your account at any time by emailing support@truefortis.com. We may suspend or close your account if you break these terms, if you don't pay, or if we reasonably believe the account is being misused. Where we can, we will tell you first and give you time to download your reports.
12. Changes to these terms
We may update these terms. We will email you at least 30 days before a change that affects you takes effect. If you keep using TrueFortis after that date, the new terms apply.
13. Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
